Terms of Service
Last updated: Effective date:
These Terms of Service (the "Terms") are an agreement between you and John Brown, an individual who operates FlexibleFox ("FlexibleFox", "we", "us"), that governs your use of the FlexibleFox workspace at flexiblefox.com, the FlexibleFox Login Helper desktop tool, and related services (together, the "Service"). If you do not agree to these Terms, do not use the Service.
On this page
1. Acceptance of these Terms
By creating an account, downloading the Login Helper, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you use the Service on behalf of a company or other organization, you confirm you have authority to bind it, and "you" includes that organization.
2. Definitions
- Account: your FlexibleFox workspace account.
- Connected Platform: a third-party platform you link to the Service, currently X (Twitter) and Xiaohongshu (RED), and others we may add.
- Login State File: a file exported by the Login Helper, such as x-login-state.json, that contains session data (including cookies) for a Connected Platform account.
- Collected Content: public posts and related data the Service retrieves from Connected Platforms at your direction.
- Drafts: text or other output the Service generates with AI models from Collected Content and your prompts.
- Credits: the usage allowance attached to your plan, such as the monthly image quota.
3. Eligibility and your account
You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract. You must provide accurate registration information and keep it up to date.
You are responsible for keeping your login credentials secure and for all activity under your Account. Tell us promptly at JohnBrownFlex@proton.me if you suspect unauthorized use. We may refuse registration or limit the number of accounts one person or organization may hold.
4. The Service
FlexibleFox is a content-operations workspace. Depending on your plan and the platform, it lets you:
- store the accounts you want to follow and the accounts you publish from;
- collect public content from followed accounts and review it in a content list;
- generate Drafts from Collected Content using prompts you manage;
- publish Drafts to supported Connected Platforms and track performance data for your own accounts on supported platforms, as indicated in the Service.
Features vary by platform and are still being added. Platforms marked as "coming soon" in the Service are not available. We may add, change, or remove features, and we do not promise that a feature will be available for any particular platform. The Login Helper desktop tool may automatically download and install updates, and we may require you to use the latest version of the Login Helper to continue accessing certain features.
5. Connecting platform accounts and Login State Files
How it works. To act on a Connected Platform on your behalf, the Service needs a Login State File. You create it by signing in yourself in a browser opened by the Login Helper, and you upload it to your Account. We never ask for, and you should never send us, your platform password.
What the file contains. A Login State File holds session data that works like a key to your platform account. Anyone who has it may be able to act as you on that platform. We use commercially reasonable technical and organizational measures to protect stored Login State Files and restrict access to them, and we use them only to perform the actions you request, such as collecting content, syncing performance data, or publishing. However, no method of electronic storage or transmission is completely secure, and you upload Login State Files at your own risk.
Your responsibilities.
- Only connect accounts that you own or are authorized to operate.
- Do not share Login State Files with others or upload files from other people.
- Replace or delete a file if you think it was exposed. You can also sign out of the platform to invalidate the session.
- Follow the terms of each Connected Platform. You are responsible for any action taken on your platform accounts through the Service, including any suspension, restriction, or loss of an account.
Platform limits. Sessions can expire or be challenged by the platform at any time, for example by a verification request. When that happens, features that depend on the file stop working until you provide a new one. We are not responsible for platform decisions or outages.
6. Content, AI-generated Drafts, and intellectual property
Your content. You keep ownership of what you upload or create in the Service, including your prompts, account information, and the Drafts you generate. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit (including to third-party AI model providers and Connected Platforms at your direction), and display that content solely as needed to provide, maintain, and secure the Service for you. We do not use your prompts, Drafts, or Login State Files to train artificial intelligence models.
Collected Content belongs to its creators. The Service retrieves public posts at your direction. We do not own them, and you receive no rights in them beyond what the original creator and the platform allow. You are solely responsible for deciding what to collect and how to use it. Collect only content you have the right to use, respect copyright and platform terms, and do not republish another person's work as your own.
AI-generated Drafts. Drafts are produced by AI models and may be inaccurate, incomplete, or similar to existing material. Review every Draft before you publish it. You are responsible for what you publish, including its accuracy, legality, and any required disclosure that content was AI-assisted. Ownership of Drafts, to the extent the law allows any, is yours as between you and us.
Our property. The Service, including its software, design, logos, and the FlexibleFox name, belongs to us and our licensors. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service and the Login Helper for your own internal business purposes under these Terms. Do not copy, reverse engineer, or resell them, except where the law does not allow this restriction. Open-source components included in the Login Helper are licensed under their respective open-source licenses.
Feedback. If you send us suggestions, we may use them without obligation to you.
7. Acceptable use
You agree not to use the Service to:
- break any law or the terms of a Connected Platform, or infringe anyone's intellectual property, privacy, or other rights;
- collect or process private, non-public, or sensitive personal data, or use Collected Content for profiling, harassment, or surveillance of individuals;
- publish spam, scams, deceptive or misleading content, impersonation, hate speech, sexual content involving minors, or other illegal or harmful content;
- run activity at a volume or frequency designed to evade platform limits, bypass security or CAPTCHA measures, or disrupt a platform;
- connect accounts you do not own or have no authority to use, or share your Account with others;
- probe, scan, or attack the Service, interfere with its operation, or access it by unauthorized means;
- resell or provide the Service to third parties without our written permission.
We may apply reasonable limits to protect the Service and may remove content or suspend features that violate this section.
8. Plans, Credits, payments, and refunds
Plans. The Service offers a free tier and paid subscription plans. The current plans, prices, and Credit allowances are shown in the Service and may change. A change in price applies from your next billing period, and we will give notice before it takes effect.
Payments. Our order process is conducted by our online reseller Paddle.com, who is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, taxes, and invoices are processed under Paddle's terms.
Billing and renewal. Paid plans are billed in advance on a recurring basis (such as monthly or annually, depending on the billing cycle you select) and renew automatically until you cancel. You can cancel at any time in the billing portal or by contacting Paddle. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Credits. Credits are a usage allowance, not money or stored value. Monthly Credits reset each billing period and unused Credits do not roll over, unless the plan states otherwise. Credits have no cash value and cannot be transferred. Credits are consumed when a generation or action request is processed, regardless of whether you are satisfied with the output or choose to publish it. Unused Credits expire when your paid plan ends after cancellation, or upon termination of your Account.
Refunds. You can request a refund within 30 days of the date of any payment, as described in our Refund Policy. Because Paddle.com is our Merchant of Record, refunds are processed by Paddle, and Paddle's Buyer Terms also apply. Nothing in these Terms limits any refund rights you have under mandatory consumer protection law.
9. Third-party services and your own API keys
The Service connects to services we do not control, including Connected Platforms, payment processors, and AI model providers. Their terms and privacy practices apply to your use of them, and we are not responsible for them.
If you enter your own model name, API key, and base URL in the settings, you authorize us to use that key to send requests on your behalf. You are responsible for the key, the charges your provider makes, and compliance with that provider's terms. Store only keys you are allowed to share, and rotate a key if you think it was exposed. We use commercially reasonable measures to protect stored API keys and do not use them for anything other than processing your requests.
Content you ask the Service to process may be sent to the model provider you choose or that we use. Do not submit information you are not allowed to share with those providers.
10. Privacy
Our Privacy Policy explains what personal data we collect, including Login State Files, and how we use and protect it. By using the Service you acknowledge that policy. When you collect content that includes other people's personal data, you are responsible for handling it lawfully.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise that the Service will be uninterrupted or error-free, that collection or publishing will succeed on any platform, that Drafts will be accurate, or that your platform accounts will not be restricted by a third party.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR CONNECTED PLATFORM ACCOUNTS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) USD 20. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.
13. Indemnity
You will defend, indemnify, and hold harmless us and our affiliates, successors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your content, prompts, or Drafts; (b) your collection or use of Collected Content; (c) your upload or use of Login State Files or third-party API keys; (d) your breach of these Terms; or (e) your violation of any law, third-party right, or Connected Platform's terms. We may, at our own expense, assume the exclusive defense and control of any matter subject to indemnification by you, and you may not settle any such claim without our prior written consent.
14. Suspension and termination
You may stop using the Service and delete your Account at any time. We may suspend or end your access, with notice where practical, if you breach these Terms, create risk or legal exposure for us or others, or if we stop offering the Service. After termination, your right to use the Service ends and we will delete or anonymize your data as described in the Privacy Policy, including stored Login State Files and API keys. Sections that by their nature should survive, including Sections 2, 6, 8, 11, 12, 13, 16, and 17, continue after termination.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we will give notice in the Service or by email before they take effect. If you keep using the Service after the effective date, you accept the updated Terms. If you do not agree, stop using the Service and cancel any paid plan.
16. Governing law and disputes
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state and federal courts located in Seattle, King County, Washington, unless mandatory consumer law gives you the right to bring a claim where you live. Before filing a claim, please contact us so we can try to resolve it informally.
Class action and jury trial waiver. To the fullest extent permitted by law, you and we agree that any dispute will be resolved only on an individual basis and not in a class, consolidated, or representative action, and both of us waive any right to a trial by jury. To the fullest extent permitted by law, any claim arising out of or related to the Service must be filed within one (1) year after it arose, or it is permanently barred.
17. General and contact
These Terms, the Privacy Policy, and the Refund Policy are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction, including to an affiliate, a newly formed business entity, or in connection with a merger, reorganization, acquisition, or sale of assets. We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including internet or cloud provider outages, third-party platform changes, or failures of AI model providers.
